By uploading, sending, or otherwise making available the Image to us, the rights holder hereby grants the right user and therefore also every person the non-exclusive, unlimited in time, space, and content, right to comprehensively use and exploit the images for all purposes, including the objective of commercial marketing and the creation of NFT´s. The granting of rights expressly includes all known and unknown forms of possibilities for offerings on the internet, websites, and social media. The right user is giving following rights to everyone:
a) The right of reproduction, public accessibility, and distribution, i.e., the right to reproduce the images, utilizing any technical means, particularly through digital integration within the website and social media presence, without limitation and to make them publicly accessible or publicly perform them;
b) the right of adaptation, i.e., the right to modify and edit the images, either personally or through third parties, while preserving the author’s moral rights, especially for the purpose of integration into the website or digitalization for social meia presence.
c) The granting of rights also includes partial use of the images and use in connection with other images.
You represent and warrant that you own all rights to the Image or otherwise have the right to grant the license set forth in Section 1 above. You further represent and warrant that the use of the Image by Company will not infringe upon or violate the rights of any third party, including copyright, trademark, privacy, or publicity rights.
You agree to release, defend, indemnify, and hold harmless Company and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable legal and accounting fees arising out of or in any way connected with (a) your breach of this Agreement, (b) your use or misuse of the Image, or (c) your violation of any third-party rights, including copyright, trademark, privacy, or publicity rights.
If there is no information about the author or rights holder for the images or individual images, the naming is at the free discretion of the rights user and the author or rights holder waives any further rights in this respect. Blankcans receives the right not to mention the name of the artist on all publications and in all types of exploitation, unless otherwise agreed before making it available in accordance with Section 1
This agreement is non-cancellable.
Unless otherwise agreed before sending/uploading, the rights holder waives any license fee and grants Blankcans and every person all of the above-mentioned rights free of charge.
7. NFT
If you want to mint a unique NFT created with your artwork as a digital record of ownership , fill out the corresponding field (your wallet address) at the time of upload. Afterwards it is no longer possible to receive the NFT for free.
8. Mention of the artist on our website
By accepting the terms and conditions and a successful cooperation, your Instagram handle will be linked on our website. If you do not agree to this, please contact us and it will of course be deleted.
9. Governing Law:
This Agreement shall be governed by and construed in accordance with the laws of Austria, without regard to its conflict of law principles and excluding the UN Convention on Contracts for the International Sale of Goods.
